Terms of Service Agreement
Effective Date: January 1, 2024
Welcome to Argus, the web and mobile service of Argus Futures, Inc. (“Argus,” “we,” or “us”). This Agreement explains the terms by which you may use our online or mobile services, website, and software (collectively the “Service”). By accessing or using the Service, you agree to these Terms of Service (“Agreement”) and consent to the collection and use of your data as outlined in our Privacy Policy.
• You must be 18 years or older (or 13+ with parental consent in the U.S.) to use the Service. Users under 18 years of age in India require parental consent under the DPDP Act.
• You agree to use the Service only in compliance with all applicable laws and regulations, including local, state, national, and international laws.
You are granted a limited, non-transferable, non-exclusive, revocable license to use the Service for personal, non-commercial purposes, subject to this Agreement. Argus reserves all rights not explicitly granted.
• Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials.
• Unauthorized Use: Notify Argus immediately if your account is compromised.
• Parental Control: Parents or guardians must supervise users under 18 in India, per DPDP compliance.
You agree not to:
• Use the Service for any unlawful purpose.
• Upload viruses, malware, or attempt to interfere with the security or integrity of the Service.
• Collect other users’ personal information without consent.
• Use the Service for unsolicited commercial purposes (spam).
• Ownership: You retain ownership of the content you post but grant Argus a royalty-free, worldwide license to use, display, and distribute it as part of the Service.
• Content Restrictions: Do not post content that is harmful, defamatory, harassing, illegal, or violates the rights of others.
• Monitoring: Argus may remove any content that violates these terms without notice.
• Updates: By using the mobile app, you agree to automatic software updates.
• App Stores: Your use of app store services is subject to those platforms’ terms of service.
• Export Control: You may not use the Service in countries under U.S. export control restrictions.
1. Pricing and Payments
• You agree to the prices and payment terms presented at checkout. All applicable taxes are included.
2. No Refunds for Partially Used Services
• Refunds are not available for partially completed services, such as assessments already taken.
3. Refund Eligibility and Process
• Refund requests must be submitted within 7 days of purchase for eligible cases like technical disruptions or service errors.
4. Refund Timeline and Method
• Approved refunds will be processed within 7-14 working days via the original payment method. If your payment method is inactive, store credit or alternative methods will be offered.
5. Grievance Redressal and Tracking
• Contact our Grievance Officer at hello@argus.ai to submit a refund request. A ticket number will be issued for tracking the status.
6. Service-specific Terms
• Rescheduling fees may apply for missed sessions or assessments, subject to availability.
7. Force Majeure
• Refunds or rescheduling may not apply for disruptions beyond our control (e.g., natural disasters)
• Data Handling: By using the Service, you consent to the collection, storage, and processing of your personal data in compliance with the Privacy Policy.
• Data Transfers: If you are located in India or the European Union, you acknowledge that your data may be transferred outside your jurisdiction.
• Security: While Argus takes reasonable measures to protect data, no security system is infallible.
The Service may contain links to third-party websites or services. Argus is not responsible for the content or privacy practices of these external services.

Arbitration Agreement
• Binding Arbitration: Any dispute will be resolved through JAMS arbitration in Alameda County, California.
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.
• Injunctive Relief: Argus may seek equitable relief in court to protect intellectual property rights.
You agree to indemnify and hold harmless Argus from any claims, damages, or losses resulting from your use of the Service, violation of these terms, or infringement of third-party rights.
The Service is provided “as is” without warranties of any kind. Argus disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Argus is not liable for indirect, incidental, or consequential damages resulting from the use of the Service. Total liability shall not exceed the fees you have paid to Argus in the past 12 months or $100, whichever is greater.
This Agreement is governed by the laws of California, without regard to conflict of law principles.
Argus may modify or discontinue any part of the Service at any time without notice. Continued use of the Service constitutes your acceptance of the changes.
We may update these terms from time to time. When we make significant changes, we will notify users through email or in-app notifications.
